1. Use of Walkways:
The walkways adjacent to SurfMaster buildings and entranceways to the units shall not be obstructed or used for any purpose other than ingress and egress.
2. Unit Exteriors:
No items shall be hung or shaken from the doors, windows, or balconies or placed upon the windowsills, balcony railings, or walkway railings in and around the Units.
3. Common Areas:
No garbage, chairs, umbrellas, coolers, wagons, floats, fishing gear, bicycles, scooters, baby carriages, or similar vehicles or toys, or other personal articles shall be placed or stored in any of the walkways or other Common Areas. Use of skates and skateboards are strictly prohibited in the Common Areas including the parking garage and ramp.
4. Unit Annoyances:
Quiet hours are from 8:00 p.m. until 8:00 a.m. Owners shall not make or permit any noise (including from pets) that will disturb or annoy the occupants of any of the Units or permit anything to be done which will interfere with the rights, comfort, or convenience of other Owners, guests or renters. Permitted contractor work hours are 8am to 6pm on Monday through Saturday. No contractor work is permitted on Sundays or federal holidays.
5. Unit Maintenance:
Each Owner shall keep their Unit in a clean and well-maintained condition. No dirt or sand shall be swept or thrown from the doors, balconies or windows.
6. Exterior Alterations:
No shades, awnings, window guards, fans, or air conditioning devices shall be used in or about any Unit except such as shall have been approved by the Board of Directors.
7. Garbage:
All garbage and trash from the Units shall be deposited with care in one of the two SurfMaster dumpsters. No garbage or trash shall be placed in stairwells, on walkways or near Unit entranceways.
8. Unit Plumbing:
Toilets, sinks, tubs and showers in any Unit shall be used for their intended purpose. Sweepings, rubbish, rags, paper, ashes or any other articles shall not be flushed down a toilet, sink, tub or shower. Any damage resulting from the misuse of any these water-related apparatus shall be the responsibility of the Owner. The associated repairs shall be paid for by the Owner.
9. Use of Property Management Staff:
Owners shall not request any property management staff member to perform any personal tasks on behalf of the Owner or their guests/renters.
10. Pets (Owners Only):
After the submission and approval of the SurfMaster Pet Registration Form, owners are permitted to have pets in their Unit and on SurfMaster property. In no event shall dogs be permitted outside a Unit unless on a leash and a SurfMaster-issued dog tag to be worn on the dog’s collar. The Owner shall indemnify the SurfMaster HOA and hold it harmless against any and all loss or liability of any kind or character whatsoever arising from or growing out of having any pet on SurfMaster property.
Guests and renters are not permitted to have pets in the unit or on Association property. The property management supervisor will notify the rental agent or unit owner of the non-registered pet(s) and allow twenty-four (24) hours to have the pet(s) removed from the unit. If the pet(s) is not removed within twenty-four (24) hours, a $100 fine for each day the pet(s) has been at SurfMaster will be assessed to the unit owner. Failure to comply may result in additional fines and penalties as determined by the Board of Directors.
11. Common Areas Alterations:
Nothing shall be altered or constructed in or removed from the Common Areas, except upon the approval of the Board of Directors.
12. Unit Electrical Equipment:
Any electrical equipment of any kind installed or used in a Unit shall fully comply with all applicable rules, regulations, and requirements. Owners shall be liable for any damage or injury caused by their failure to comply with all applicable rules, regulations, and requirements.
13. Access to Units:
The Board of Directors or its agents may enter any Unit at any reasonable hour of the day after notification to the Owner (except in case of emergency) for the purpose of: locating and identifying a maintenance issue; repairing an item within the scope of HOA’s responsibility; and inspecting Units for the presence of any vermin, insects, or other pests and for the purpose of taking such measures as may be necessary to control or exterminate any such vermin, insects, or other pests.
14. Unit Keys:
The Board of Directors, or its designated agent, shall retain a key to each Unit. No Owner will alter any lock or install a new lock on any Unit door without prior notification and approval by the property management supervisor. Upon approval, the Owner will provide the property management supervisor with an additional key pursuant to its right of access of the Unit. Keypad entry locks are permitted. In such cases, the Owner will provide the property management supervisor with both the physical key and current access code associated with the Unit door lock.
15. Parking:
Owners and their guest/renters shall use the appropriate SurfMaster-issued parking permits to park their vehicles on SurfMaster property. Contractor vehicles, golf carts, boats, trailers, jet skis (and the like) are not allowed to be parked on SurfMaster property. Contractor vehicles may park in the parking areas located in front of SurfMaster. All Owner and their guest/renter vehicles must visibly display valid SurfMaster-issued parking permits or be subject to immediate removal at the Owner’s expense.
16. Damage to Common and Limited Common Areas:
Any repair of damage to a Common Area or Limited Common Area caused by an Owner (or their guest/renter) by moving or carrying of any article (or other damaging activity) onto or about SurfMaster property shall be financial responsibility of the Owner.
17. Use of Water:
Water from unit sinks, tubs, showers or outside hoses shall not be left running for any unreasonable or unnecessary length of time.
18. Inflammable Fluids and Other Hazards:
Owners are not permitted to use or permit to be brought onto SurfMaster property any inflammable fluids (such as, gasoline, kerosene, naphtha, or benzene, or other explosives or hazardous items) without the prior approval of the Board of Directors or property management supervisor.
19. Placement of Names on Unit Entries Prohibited:
Owners shall not be permitted to affix their names on any entry to their Unit or SurfMaster Common Areas.
20. Unit Owner Absence:
Owners and their guests/renters shall close all windows and doors while their Units are unattended to avoid possible damage from storm, rain, freezing or other elements. During all winter months, heating units will be left on 55 degrees or higher to assure that sufficient heat is contained in each Unit to prevent the freezing of pipes or other damage from cold weather.
21. Swimming Pools and Spas:
The swimming pools and spas may be used by Owners and their guests/renters. The Board of Directors may restrict the number of guests/renters that may use the swimming pools and spas. All persons must abide by the swimming pool and spa rules posted in the pool areas.
22. Unit Window Covering:
Owners must install and maintain either draperies, curtains, or blinds on all Unit windows and sliding glass doors. The color of the portion of such draperies, curtains or blinds visible from the Unit exterior shall be white or off-white.
23. Fireworks Prohibited:
SurfMaster has been designated a Horry County fireworks free zone. No fireworks are allowed in or about SurfMaster, including the beach area in front of SurfMaster.
24. Outdoor Grilling:
With the exception of electric grills; no grills or stoves are permitted to be used on Unit balconies or in Common Areas (including the parking structure).
25. Signs Prohibited:
No signs of any nature, including (without limitation) "For Sale" or “For Rent” signs, shall be placed on or about SurfMaster or any Unit. This prohibition includes signs on Unit windows, doors and sliding glass doors.
26. Unit Rentals:
Rentals shall not be permitted to house parties or other similar groups whose presence is likely to result in disturbance or annoyance to other occupants of the SurfMaster (which disturbance or annoyance is anticipated because of the number of the persons in the group, the lack of adequate mature supervision, or the general conduct or appearance of the group). Each Owner using a rental agent shall be certain that such rental agent agrees to enforce this rule. The Board of Directors may prohibit the use of any rental agent who willfully violates this Rule.
27. Complaints:
Complaints regarding any Unit, Common Area or Limited Common Area shall be made to the property management supervisor or Board of Directors.
28. Rule and Regulation Amendments:
Any consent or approval given under these Rules and Regulations by the Board of Directors shall be revocable at any time. These Rules and Regulations may be revised, added to or repealed at any time by the Board of Directors.
